1. About these terms
These Terms of Service explain the rules that apply when you visit emae.design, create an account or purchase products from emaé design.
Throughout these terms, “emaé design”, “we”, “us” and “our” refer to the business operating emae.design. “You” and “your” refer to the person using our website or purchasing from us.
By using our website or placing an order, you agree to these terms. Please read them before completing a purchase.

2. Our online store
Our store is hosted by Shopify, which provides the ecommerce platform through which we display and sell our products.
Your purchases are made from emaé design. Shopify, our payment providers, production partners and delivery partners provide supporting services but are not the seller of the artwork to you.
You must be at least 18 years old, or have permission from a parent or legal guardian, to place an order.
You agree to provide current, complete and accurate information when placing an order or creating an account.
3. Products and artwork
We sell art prints, framed artwork and related products.
We make reasonable efforts to ensure that product descriptions, dimensions, materials, prices and photographs are accurate. Images shown in room settings are illustrative and may not represent exact scale. Please check the stated measurements before ordering.
Colours can appear differently depending on screen type, brightness, colour settings and ambient lighting. Physical prints may therefore show reasonable differences from their on-screen presentation. This does not affect your rights if a product is faulty, materially misprinted or not as described.
Some products are based partly on public-domain or openly licensed historical material. emaé design does not claim ownership of an underlying public-domain work. Rights may nevertheless exist in our original compositions, edits, typography, colour treatments, branding, product photography and other creative contributions.
Frames, paper types, dimensions and other product options are displayed on the relevant product page. Availability may vary by product and destination.
4. Products made to order
Most emaé design products are produced after an order is placed. Production may begin shortly after checkout.
Being produced to order does not, by itself, remove any cancellation or return right that applies under consumer law.
Products made to your individual specifications or clearly personalised for you may be excluded from change-of-mind cancellation rights where permitted by law. This may include artwork containing customer-supplied names, dates, wording, locations, photographs or other personalised information.
Personalised products remain covered by your legal rights if they are faulty, damaged, incorrectly produced or not as described.
5. Placing an order
When you submit an order, you are offering to purchase the selected products in accordance with these terms.
After checkout, we will normally send an order acknowledgement. This confirms that we have received your order but does not necessarily mean that it has been accepted.
A contract is formed when we confirm that the order has been accepted or dispatched, whichever occurs first.
We may decline or cancel an order before acceptance where there is a reasonable reason to do so, including:

Payment cannot be authorised

Information supplied with the order is incomplete or appears incorrect

We cannot deliver to the supplied address

A pricing or product-description error is identified

We reasonably suspect fraud, misuse or unlawful activity

A technical problem prevents us from fulfilling the order as described
If we decline or cancel an order after receiving payment, we will refund the affected amount promptly to the original payment method.
We will not cancel an accepted consumer order without a reasonable basis or in a way that removes your legal rights.
6. Order changes and cancellations
Because production can begin quickly, contact customerservice@emae.design immediately if you need to amend or cancel an order.
We will make reasonable efforts to help, but we cannot guarantee that an order can be changed or stopped once production has begun.
Cancelling an order through a customer account, payment provider or other service may not automatically stop production. Please contact us directly.
Your legal cancellation and return rights are explained in our Returns and Refunds Policy. That policy forms part of these terms.
7. Prices and payment
Prices are shown in the currency selected or detected by the store.
Applicable taxes will be included in the displayed price or calculated at checkout as required. Delivery charges and any other mandatory charges will be shown before you confirm the order.
You must provide valid payment information and be authorised to use the selected payment method.
Payment may be processed by Shopify Payments or another payment provider displayed at checkout. We do not directly receive or store your complete payment-card details.
We may change prices at any time, but a price change will not affect an order we have already accepted.
If we discover an obvious pricing error before accepting an order, we will contact you. You may choose to proceed at the correct price or cancel the order for a full refund. We will not increase the agreed price of an accepted order without your agreement.
8. Promotions and discount codes
Promotions, introductory offers and discount codes may be subject to additional conditions displayed with the offer.
Unless stated otherwise:

Discount codes cannot be exchanged for cash

Only one discount code may be used per order

Codes must be applied before checkout is completed

Discounts do not apply retrospectively

Promotions may have a stated end date or availability limit
We may withdraw or correct a promotion where there is a genuine error, misuse or technical problem. We will not remove a discount from an order that has already been accepted unless the discount was obtained fraudulently or through clear misuse.
Sale products retain the same statutory rights as full-price products.
9. Delivery
Estimated production and delivery times are displayed on the website or during checkout. These are estimates unless we expressly agree to a guaranteed delivery date.
Products may be manufactured and dispatched by selected production partners located near the delivery destination. Items in the same order may occasionally arrive separately.
You are responsible for providing a complete and accurate delivery address. Contact us immediately if you notice an error.
If delivery is delayed, lost or unsuccessful, contact customerservice@emae.design. We will investigate and provide an appropriate remedy where required.
Risk of loss or damage generally passes to you when the product is delivered into your physical possession or to a person you nominated to receive it.
Nothing in these terms removes any legal rights you may have concerning late, failed or damaged delivery.
10. International orders
We may sell and deliver to customers outside the United Kingdom.
Product availability, production location, delivery times, currencies and taxes may differ by destination.
Where customs duties, import taxes or handling charges are not collected at checkout, the recipient may be responsible for paying them. We will provide information about known charges where reasonably possible, but customs authorities determine the final amount.
Mandatory consumer rights applying in your country or region are not removed by these terms.

Products must be of satisfactory quality, fit for any purpose made known to us and match their description. Nothing in these terms limits the remedies available to you when those requirements are not met.

12. Accounts
You may be able to create an account to review orders, save information or access other store features.
You are responsible for:

Keeping your login details secure

Not allowing another person to misuse your account

Notifying us if you believe your account has been accessed without permission
We may suspend or close an account where reasonably necessary to protect you, other customers or the website from fraud, security threats, unlawful use or serious breaches of these terms.
Closing an account does not affect orders already accepted, outstanding payments or legal rights that arose before closure.
13. Acceptable use
You must not use our website:

To infringe copyright, trademark, privacy or other rights

To submit malicious code, viruses or harmful material

To interfere with the website’s security or operation

To gain unauthorised access to an account, system or data

To scrape, harvest or systematically extract website content without permission

To place orders using stolen or unauthorised payment information

To make false claims or misuse our customer-service processes
Reasonable personal browsing, sharing links and use of normal search-engine indexing are not prohibited.
We may restrict access where reasonably necessary to prevent harmful or unlawful activity.
14. Intellectual property
Unless otherwise stated, the emaé design name, logo, branding, website design, original artwork, compositions, product photography, text, graphics and other original content are owned by or licensed to emaé design.
You may browse the website and download or print reasonable extracts for personal, non-commercial use.
You may not, without written permission:

Reproduce our original artwork for resale

Create products using our designs

Remove copyright, trademark or attribution notices

Republish substantial parts of the website

Present our work as your own

Use our branding in a way that suggests endorsement or affiliation

Use website content to build a competing catalogue or commercial image library
Nothing in these terms claims exclusive ownership over material that is genuinely in the public domain. However, a public-domain source may have been incorporated into a new emaé design composition containing original protected elements.
If you believe content on our website infringes your rights, contact customerservice@emae.design with sufficient information for us to investigate.
15. Customer submissions and reviews
If you submit a review, photograph, comment or other content, you confirm that:

You created it or have permission to submit it

It does not infringe another person’s rights

It is not unlawful, misleading, abusive or defamatory

It does not contain malicious software or confidential information
You retain ownership of your content.
You give us a non-exclusive, worldwide, royalty-free permission to display, reproduce and adapt the submitted content for operating and promoting emaé design. This permission only applies to the content you voluntarily submit for that purpose.
We will not claim ownership of your personal photographs or use them in an unrelated manner.
We may moderate or remove submissions that breach these terms, but we are not obliged to publish every submission.
We will not knowingly publish fabricated customer reviews.
16. Third-party services and links
Our website may use or link to services provided by Shopify, payment processors, production partners, delivery companies, review providers, social networks and other third parties.
Those services may have their own terms and privacy policies. A link does not necessarily mean that we endorse every statement, product or service on the linked website.
We are responsible for our obligations to you as the seller. We do not avoid those obligations merely because we use a contractor, fulfilment provider or other third party.
We are not responsible for losses caused solely by your independent use of a third-party website that is not under our control.
17. Website availability
We aim to keep the website accurate, secure and available, but occasional maintenance, technical problems or events outside our reasonable control may interrupt access.
We may update, suspend or withdraw website features where reasonably necessary. This will not remove rights relating to orders we have already accepted.
If an interruption affects an order, contact us and we will take reasonable steps to resolve the issue.
18. Our responsibility to you
We are responsible for losses that are a foreseeable result of our breach of these terms or our failure to use reasonable care and skill.
We are not responsible for losses that are not reasonably foreseeable, or for business losses where you purchased the product wholly or mainly for commercial purposes.
We do not exclude or restrict responsibility for:

Faulty or misdescribed goods

Breach of your statutory consumer rights

Any other responsibility that the law does not allow us to exclude
If you use products in a manner inconsistent with their normal decorative purpose or contrary to supplied care instructions, we may not be responsible for damage caused solely by that misuse.
19. Events outside our reasonable control
We are not responsible for delay caused by events genuinely outside our reasonable control, such as severe weather, natural disasters, widespread carrier disruption, industrial action, war, civil emergency, government action or major infrastructure failure.
If such an event affects an accepted order, we will contact you where reasonably possible and take reasonable steps to reduce the disruption.
If delivery becomes impossible or is delayed substantially, you may have the right to cancel and receive a refund for undelivered products.
20. Privacy and cookies
Our Privacy Policy explains how we collect, use and protect personal information.
Our Cookie Policy or cookie-preference tool explains the technologies used by our website and allows you to manage optional cookies where required.
By using the website, you acknowledge that your information will be handled as described in the applicable privacy notices.
21. Complaints
If you are dissatisfied with a product or our service, contact:

We will acknowledge and investigate complaints fairly and aim to provide a substantive response within a reasonable period.
Nothing in this section prevents you from obtaining independent consumer advice or exercising your legal rights.
22. Changes to these terms
We may update these terms to reflect changes in our business, website, products, technology or legal obligations.
The updated version will be published on this page with a revised “last updated” date.
Changes will not retrospectively alter the essential terms of an order that we have already accepted unless:

23. Severability
If a court or competent authority decides that part of these terms is unlawful or unenforceable, the remaining terms will continue to apply.
The affected provision should be interpreted or adjusted only to the minimum extent necessary to make it lawful and enforceable.

If we do not immediately enforce a right under these terms, that does not mean we have permanently given up that right.
25. Third-party rights
These terms are between you and emaé design. Except where the law provides otherwise, no other person has a right to enforce them.
26. Governing law and courts
These terms and contracts formed through our website are governed by the laws of England and Wales.
If you are a consumer living elsewhere, you retain the benefit of mandatory consumer protections applying in your country of residence.
Consumers may bring proceedings in any court that has jurisdiction under applicable consumer law. Nothing in this section is intended to make it unreasonably difficult for you to exercise your legal rights.
